
TERMS AND CONDITIONS
Finickity Fayre – Terms & Conditions of Hire
Effective Date: 5 July 2026
These Terms & Conditions apply to all bookings made with Finickity Fayre ("we", "our", "us"). By confirming a booking, you ("the Customer") agree to these Terms.

1. Booking
A booking is confirmed once:
-
We have accepted your booking request in writing.
-
Any required booking fee or deposit has been received.
-
Where requested, the hire agreement has been signed electronically.
Until these steps have been completed, dates cannot be guaranteed.

2. Quotations
All quotations are valid for 30 days unless stated otherwise.
Prices include only the items and services listed in the quotation. Additional equipment, delivery distances or waiting time may incur additional charges.

3. Payments
Unless otherwise agreed:
-
A booking fee of £100 is payable when confirming your booking.
-
The remaining balance is due no later than 30 days before the event.

Bookings made within 30 days of the event require full payment at the time of booking.
Payments may be made using the payment methods we make available, including bank transfer and secure online payments.
Failure to pay by the due date may result in cancellation of the booking.

4. Cancellations
By the Customer
Written notice must be provided if you wish to cancel.
Unless otherwise agreed:
-
More than 30 days before the event – non-refundable deposit of £100 retained.
-
Less than 30 days – 100% of the booking value payable.
If we are able to rebook the date, we may reduce cancellation charges at our discretion.

By Finickity Fayre
In the unlikely event we need to cancel due to circumstances beyond our reasonable control, any payments already made will be refunded in full.
Our liability is limited to the amount paid by the customer.
​
5. Changes to Bookings
We will do our best to accommodate changes, but cannot guarantee availability.
Additional items or services may increase the total booking price.

6. Delivery and Collection
Where delivery and collection are included:
-
Someone aged 18 or over must be present at the agreed delivery and collection times (this can include venue staff).

Clear access must be available.
-
Delays caused by restricted access, unavailable venues or waiting time may incur additional charges.

7. Customer Responsibilities
The Customer agrees to:
-
Take reasonable care of all hired equipment.
-
Supervise children using the equipment.
-
Ensure equipment is used safely and appropriately.
-
Prevent misuse, vandalism or theft.
-
Notify us immediately of any damage.
Equipment must not be altered, repaired or moved to another venue without our permission.

8. Equipment Location
Equipment must remain at the agreed venue unless we have given prior written consent.
​
9. Weather
Many traditional games are suitable for outdoor use only in appropriate weather conditions.
The Customer is responsible for providing suitable shelter where necessary.
If weather conditions make use unsafe, we reserve the right not to install or to remove equipment.
This decision is made in the interests of customer safety and protecting the equipment.

10. Damage or Loss
The Customer is responsible for any loss or damage beyond normal wear and tear while the equipment is in their care.
Repair or replacement costs may be charged where damage results from negligence, misuse or theft.

11. Safety
Customers must follow any instructions provided.
Equipment must not be used:
-
while under the influence of alcohol or drugs;
-
for purposes other than those intended;
-
in unsafe weather conditions where advised against.
We reserve the right to suspend use of equipment if unsafe behaviour is observed.

12. Venue Requirements
The Customer is responsible for ensuring:
-
sufficient space is available;
-
suitable ground or flooring is provided;
-
the venue permits the use of hired equipment.
​
13. Liability
We will provide our services with reasonable care and skill.
Nothing in these Terms limits or excludes liability where it cannot legally be excluded.
Except where prohibited by law, our total liability shall not exceed the total amount paid for the booking.
We are not responsible for indirect or consequential losses.

14. Photography and Social Media
We may feature photographs or video footage of our games and equipment taken at events for use on our website, social media channels and other marketing materials.
These images are typically captured by professional photographers, content creators, or videographers engaged by the Customer or their event suppliers. Where such content is used, we will either:
-
rely on permission granted by the Customer or the event photographer/content creator/videographer; or
-
seek permission directly from the Customer or the relevant rights holder where required.
If you do not wish for any images or footage from your event to be used for marketing purposes, please notify us before your event. We will respect your request wherever reasonably possible and take steps to avoid using such content.

15. Privacy
Personal information is handled in accordance with our Privacy Policy.
​
16. Force Majeure
Neither party shall be liable for delays or failure to perform caused by events beyond reasonable control, including severe weather, flooding, fire, government restrictions, industrial action or other unforeseen circumstances.

17. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
